1 Scope
These Terms apply to every order you place with Simena Digital LLC · 1021 E Lincolnway, Suite 9026, Cheyenne, WY 82001, USA (“SmashMyTest”, “we”), and to your use of this website. By placing an order you accept these Terms, the Cancellation Policy and the Privacy Policy. If you do not agree, do not order.
We are not the test publisher, the employer, the recruiter or the assessment provider, and we are not affiliated with SHL, Aon (cut-e), Talogy, Saville or any other publisher. Their names describe the test format only, and all trademarks belong to their owners.
2 Services
At your instruction we take a selection test on your behalf: Adrian accesses the test you were invited to, takes it in your name, by the deadline you give us, and the result is reported back in your order.
The test, its format, its scoring and any later verification belong to the publisher. We do not supply or forward test content: we take the test that was sent to you.
We do not guarantee any score, percentile, pass, interview, offer or job. The result depends on the test, the employer and factors outside our control.
3 Contract
The order is placed when you complete checkout and the payment is confirmed. The contract then starts between you and Simena Digital LLC. The version of these Terms and the price shown at checkout when you order apply.
We may refuse or cancel an order if we reasonably believe it is fraudulent, unlawful or abusive, or if your test date is too close for the service to be performed properly. If we refuse before we start, we refund the amount paid.
4 Prices and payment
All prices are in US dollars and include applicable taxes. The price shown at checkout is the price you pay. Payment is processed by Stripe; we do not store your card details.
If something is wrong, contact us before raising a chargeback. A chargeback for a service we have started or delivered may be disputed, and we may recover the payment provider’s costs to the extent the law allows.
5 Delivery
Standard delivery is within 72 hours of the details and the access we need; Express is within 24 hours, subject to availability. The clock starts when we have what we need, not when you first open the checkout.
We are not responsible for a missed deadline caused by missing or wrong access, an unavailable platform, a one-time code you did not pass on, or a change to the test by the employer or the publisher.
6 Fit promise
If the result does not match the test details you gave us, tell us in the chat and we redo the test once, free. “Match” means the company, the test or publisher, the format and the deadline you told us; it does not mean a particular score.
The fit promise is the remedy for a mismatch. It is not a guarantee of a result.
7 Cancellation
The service starts immediately after payment: by placing the order you ask us to start. You can cancel for a full refund any time before we start the session, that is before we use your invite link and login to access the test.
Once the session has started the order is final and non-refundable, except where we fail to deliver or the law requires a refund. This includes the Express fee.
To cancel, write in the order chat or email hello@smashmytest.com before the session starts. Refunds go back to your original payment method via Stripe, usually within 5–10 business days. Details: Cancellation policy.
8 Liability
The service is provided “as is” and “as available”, without warranties of any kind, express or implied. To the maximum extent the law allows, our total liability for an order is limited to the amount you paid for that order.
We are not liable for indirect or consequential loss, lost profits, lost opportunities or loss of reputation; for any decision by an employer, recruiter or publisher; for an application being rejected; for a test being verified or challenged; or for an account or a result being restricted.
Nothing here excludes liability that cannot be excluded by law, including fraud, death or personal injury caused by negligence, and nothing removes a right you have under mandatory consumer law.
9 Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles. Before any formal dispute, write to hello@smashmytest.com and give us 30 days to resolve it.
A dispute that is not resolved that way is settled by binding arbitration under the rules of the American Arbitration Association, unless mandatory consumer law gives you another forum. Mandatory consumer protection rights of your country of residence remain unaffected.
10 About our reviews
The reviews on our website come from real past clients. To protect their privacy we show first names only and lightly edit the wording; we never change what they said or how they rated us. We don’t pay for reviews.
11 Your responsibilities
You give us accurate details: the company, the test or publisher, the test date and deadline, the invite link, the username or ID, and the password or access instructions. If a detail is wrong, missing or changes, tell us in the chat at once. Time lost through wrong or missing access is not our responsibility.
You are responsible for the access itself: the invitation, the login, any one-time code, any account you must create, and the employer’s own platform. Send a one-time code as soon as it arrives.
You are responsible for checking the rules of the employer, the recruiter and the publisher before you order, and for following them. Whether the test may be taken for you is a matter between you and them; we perform the service you ask for. To the extent the law allows, you accept the risk that a publisher, employer or check later notices, questions or restricts anything.
12 Indemnity
You indemnify us against claims, losses, costs and reasonable legal fees arising from your breach of these Terms, your misuse of the service, or a claim by an employer, publisher or third party about the test you asked us to take, to the extent the law allows.
13 Privacy and data
Our Privacy Policy explains what we collect, why, how long we keep it and your rights. You must read it before ordering. It covers the invite link, the username and the password you send us, and everything you write in the chat.
We process your data to perform the order, to take payment, to answer you and to meet our legal duties, as the Privacy Policy sets out.
14 Changes, severability and contact
We may update these Terms. The version at checkout when you order applies to that order, and continued use after a change accepts the revised Terms.
If a clause is unenforceable, the rest stays in force and the unenforceable clause is replaced by the closest enforceable rule.
